Squelch is committed to protecting the privacy of individuals.

This privacy policy (“Privacy Policy”) is to help you understand what information we collect through our website (the “Website”) and hosted service (the “Service”), how we use that information, how we may share it, how we safeguard it and what choices you have. The terms “we,” “us,” or “our,” refer to Squelch, Inc., a Delaware corporation dba Squelch, headquartered at 555 Twin Dolphin Drive Suite 170, Redwood City, CA 94065 in the United States.

We may make changes to this Privacy Policy from time to time. The Privacy Policy will be located at https://squelch.io/about-us/privacy/. If we make material changes to this Privacy Policy, we will notify you by posting a notice on this webpage or, if you maintain a current e-mail address on file with us, notifying you via e-mail communication to your e-mail address on record. We encourage you to keep the e-mail address you provide to us current, and to promptly notify us of any changes to your email address, so that you may receive any notices we send to you regarding material changes to this Privacy Policy. When you use the Service after any changes to this Privacy Policy, your use will be subject to the revised version of this Privacy Policy.

Information Collected by Us

We collect information about you from various sources:

Information provided by you

Navigating to and browsing our Website does not require any registration. If you contact us by email or through the Web Site, we may keep a record of your contact information and correspondence, and may use your email address, and any information that you provide to us in your message, to respond to you. We treat this information as we would treat any other unsolicited business correspondence, and have no obligation to keep this information confidential, nor to take any security measures to protect this information.

Use of the Service will require a registration consisting of your corporate email address and a password that you specify. Additional personal information may be requested during the registration process.

Information automatically collected by us

We may collect information in connection with your use of the Website or Service, or through the use of analytics services as described in the “Tracking Technologies” section, below. This information includes, but is not limited to the following:

  • the Internet Protocol (IP) address of the device from which you access the Website or Service;
  • the nature and identification of the device from which you access the Website or Service, including operating system, device characteristics and unique device identifier;
  • the specific actions that you take while using the Website or Service;
  • the time, frequency and duration of your use of the Website or Service;
  • any search terms that you may enter onto the Service; and
  • and information and materials you share while using the Service.

Customer Data

As part of the Service delivered to our customers, data and information (“Customer Data”) may be made available to us for the purpose of providing the Service, which could include processing, organizing, categorizing and indexing such Customer Data. Customer Data may include, without limitation, information about the identity of customer personnel, and customers’ users (such as name, address, phone number, email and IP address) as well as other information attributable to such users (such as online activity, purchases made, or services used).

We do not have a direct relationship with the individuals whose information may be contained in the Customer Data. Each of our customers has its own privacy policy regarding the collection and use of personal information. This Privacy Policy does not apply to Customer Data and so we recommend that users refer to our customers’ privacy policies with respect any Customer Data that they have made available to us in connection with our delivery of Services. The use of Customer Data provided by our customers in connection with our Services is subject to the agreements between us and our customers. We are not responsible for our customers’ privacy policies or actions with respect to Customer Data.

Tracking Technologies

Generally. We, and third parties with whom we interact, including our third-party service providers, may use cookies, web beacons and similar technology in connection with your use of the Website and Service (collectively referred to in this policy as “Cookies”). Cookies are small data files that may have unique identifiers, and reside, among other places, on your mobile device, in emails we send to you and in our applications. Web beacons are small strings of code that provide a method for delivering a graphic image on a web page or in an email message for the purpose of transferring data.

If Cookies are used, they may be used to collect information about you and your use of the Website or Service, such as your browser type, search preferences, and the date and time of your use. We sometimes use service providers to help us provide certain products and services or to integrate other features. Disabling Cookies. It may be possible to disable Cookies through your device settings. However, doing so may cause portions of the Website or Service to not function, or to function improperly, or otherwise affect your ability to use the Website or Service.

Do Not Track. In addition, you may be able to adjust your browser settings or other settings so that “do not track” requests are sent to the websites and mobile applications that you use. However, we will not disable tracking technology that may be active on the Website or Service in response to any “do not track” requests that are sent to the Service.

How We Use Your Information

We may use information that we collect about you through the Website or Service to: (A) provide the Website and Service and to provide you with requested services and customer support and to process and respond to your inquiries, (B) personalize, customize, measure and improve our services, content and advertising, and otherwise to enhance your experience of the Website and Service, (C) prevent, detect and investigate potentially prohibited or illegal activities, (D) analyze the accuracy, effectiveness, usability or popularity of the Website or Service, (E) generate and review reports and data about our user base and service usage pattern, (F) resolve disputes and troubleshoot problems, (G) contact you with information, including promotional and marketing information and recommendations that we believe may be of interest to you, (H) provide you with other services requested by you as described when we collect the information and (I) take any other action as otherwise stated in this Privacy Policy.

You may opt out of receiving promotional and marketing messages at any time by contacting us at privacy@squelch.io, by changing settings in your Services account, or by clicking on a link contained within those messages. You will not be able to opt out of administrative messages regarding the Service.

Information We Share with Third Parties

We may disclose your information to the following third parties:

Our Service Providers. We may share your information with third-party contractors, agents,
business partners or service providers who provide certain services to us or on our behalf to
operate and support the Website and Service. These service providers will only have access to
the information needed to perform these limited functions on our behalf.

Companies that Acquire Our Business or Assets. If we become involved in a merger, acquisition, sale of assets, securities offering, bankruptcy, reorganization, dissolution or any other transaction, or if the ownership of all or substantially all of our business otherwise changes, we may share or transfer your information to a third party or parties in connection with the applicable transaction.

Our Affiliates. We may share some or all of your information with subsidiaries and corporate affiliates.

Aggregate Information Shared with Third Parties. Compliance with Law, Legal Enforcement; Protection and Safety. We may disclose your information to law enforcement, governmental agencies or authorized third parties as required by law. We may disclose or use your information as we believe reasonably necessary or appropriate to prevent or stop any other activity that may expose us or any other party to liability, or to protect our rights, property or safety, or the rights, property or safety of any other party. We may also disclose your information in response to court orders, subpoenas or other legal or regulatory requests, and we may disclose or use your information as we believe reasonably necessary or appropriate to our legal counsel and other consultants in connection with actual or potential litigation or other legal proceedings.

Other Third Parties. Your information may also be disclosed to third parties in unforeseeable situations or situations that are not preventable even when commercially reasonably protections are employed, such as in the case that we or the Website or Service are subject to a hacking or other attack.

Privacy Shield

We abide by the Privacy Shield Principles of the EU-U.S. Framework regarding the collection, use and retention of personal information collected by organizations in the European Union and Switzerland, as set forth by the U.S. Department of Commerce (“Privacy Shield”). We have certified to the U.S. Department of Commerce that we adhere to the Privacy Shield Principles. For more information please visit PrivacyShield.gov.

In particular, we comply with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions. We remain responsible in accordance with the Privacy Shield Principles if third-party agents that we engage to process such personal data on our behalf do so in a manner inconsistent with the Privacy Shield Principles, unless we prove that we are not responsible for the event giving rise to the damage.

Please contact us should you have any questions or complaints regarding our compliance with the Privacy Shield. If your Privacy Shield complaint is not resolved through contacting us, you have the right to invoke binding arbitration, at our sole cost and expense, with JAMS Privacy Shield Program. Under certain conditions, described on the Privacy Shield website, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.

Other MattersSecurity. We take reasonable measures to protect the information you provide to us or submit through the Service against loss, theft, unauthorized use, disclosure or modification. However, we cannot guarantee or warrant the security of any information you transmit to us or submit through the Service and you do so at your own risk.

Accessing, Changing and Managing Your Information. You may change and update the information you provide through the Website or Service, or change your preferences concerning how we use your information, as follows:

Changing or Updating Account-Holder Information. You can access or change your Service Account information or delete your Service account through your Service account settings page or by contacting us at support@squelch.io. If you choose to delete or deactivate your account, you may not reactivate your account, although you may create a new one. We’ll take reasonable steps to provide, modify or delete your information as soon as is practicable, but some information may remain in archived/backup copies for our records or as otherwise required by law or (if you are using the Service on behalf of one of our customers, as required by our agreement with that Customer). We may limit or reject your request in certain cases, including without limitation where the burden or expense of providing access would be disproportionate to the risks to your privacy in the case in question, where the rights of other persons would be violated, or as required by law.

Customer Data. We have no direct relationship with the individuals whose personal data may be contained within the Customer Data processed by our Service. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate personal data provided by one of our customers should direct their query to that customer. If the customer requests that we remove or modify the data, we will respond to their request as soon as is practicable. Third Parties. The Website or Service may contain links to websites that are not owned or operated by us. We are not responsible for the privacy practices of other sites. This Privacy Policy applies solely to information collected by the Website and Service. If you visit third party websites or provide any information directly to parties other than us (even if those websites display our brand), different policies may apply to the collection and use of your information. We encourage you to investigate and ask questions before accessing third-party websites or applications or disclosing information to third parties.

No Use by Children. The Service is not intended for use by children under the age of 13. We will never knowingly collect information directly from children under the age of 13 without verifiable parental consent. If you are under the age of 13, you may not use the Service and please do not provide us with information of any kind whatsoever. If we become aware that a user is under the age of 13 and has submitted information to the Service without verifiable parental consent, we will remove his or her information from our files and deactivate his or her account. If you have reason to believe that we may have accidentally received personal information from a child under the age of 13, please contact us immediately at privacy@squelch.io.

United States Operation. The Service is operated from the United States. If you are located
outside of the United States and choose to use the Website or Service or provide your
information to us, you agree that your information will be transferred, processed and stored in
the United States. The privacy laws of the United States may not be as protective as those in your
jurisdiction. Your agreement to the terms of this Privacy Policy followed by your submission of
information in connection with the Service represents your agreement to this practice.

Notice of Privacy Rights to California Residents: Section 1798.83 of the California Civil Code permits California residents to request from a business, with whom the California resident has an established business relationship, certain information about the types of personal information the business has shared with third parties for those third parties’ direct marketing purposes and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year.
